CALL FOR APPLICATIONS TO SERVE ON THE GAUTENG DEPARTMENT OF AGRICULTURE, RURAL DEVELOPMENT AND ENVIRONMENT EXTERNAL ADVISORY PANEL ON APPEALS
NOTICE IN TERMS OF SECTION 43(5) OF THE NATIONAL ENVIRONMENTAL MANAGEMENT: 1998 (ACT 107 OF 1998)
In accordance with Section 43 (5) of the National Environmental Management Act, 1998 (Act 107 of 1998) (the NEMA), the Member of the Executive Council (MEC) responsible for Social Development, Agriculture, Rural Development and Environment may appoint an external advisory Appeals Panel to consider and advise the MEC on any appeal submitted to the MEC in terms of the NEMA.
The MEC, Ms. Mbali Hlophe, is seeking to appoint suitable qualified candidates to serve on the External Advisory Appeals Panel of the MEC (the Panel).
Applicants should have technical expertise and experience in following fields:
- Environmental Speciality (including but not limited to Environmental Impact Assessment Specialist, Wetland specialist, Environmental Technologist, Biodiversity and Environmental Scientist);
- Agriculture;
- Law (Environmental Law and Administrative Law);
- Sustainable Development; and
- Geotechnology.
The Panel to be appointed by the MEC shall consider independent and impartial manner appeals lodged in terms of Section 43 (1) of the NEMA pertaining to administrative decisions issued by the Department and make written recommendations to the MEC on such appeals.
These administrative decisions include, inter alia, Environmental Authorisations, Compliance Notices and S2G Administrative Fines.
Appointed Panel members shall serve on the Appeal Panel for a term not exceeding three (3) years.
